Proposed Bill to Criminalize Robocalls without Prior Consent

One New York senator apparently wants to take telemarketing enforcement to the next level. In a bill sponsored by New York Senator Chuck Schumer, the senator proposes the so called “QUIET Act” that would make it a criminal offense to call someone using an ATDS (based off of the same murky definition used in the TCPA) without their “prior express written consent”. Any person found in violation of this proposed law could be fined for up to $20,000 per violation, and imprisoned for up to 10 years.

Thankfully it does not appear that this bill has gained much traction in the senate, but any NY call centers out there may want to give the senator a call and express their opinion on the matter (however, it might not be a very good idea to robocall his office).
