TCPA Exemption Quick Guide
The Telephone Consumer Protection Act (TCPA), enacted in 1991, establishes rules for telephone marketers, text marketers and collection agencies. These rules include things like calling time restrictions, restrictions on the use of automatic telephone dialing systems, requirements to suppress phone numbers against the National Do Not Call (DNC) Registry and internal DNC lists, ID requirements, rules for robocalls, and more. The act gives the Federal Communications Commission (FCC) the authority to collect complaints and institute enforcement actions against violators of the TCPA. Importantly, Congress has authorized a private right of action for individuals to sue under the TCPA, causing a significant amount of class action lawsuits.
As with all rules, there are certain exceptions. The FCC has defined special exemptions for specific industries and types of organizations. These exemptions do not grant infallibility, and we strongly advise consulting an attorney before assuming any exemptions apply to you.
